User Agreement
This Agreement governs your access to and use of vaicat's services, including our websites, applications, and related platforms.
- You must be at least 16 years old to use our services
- You retain ownership of content you create
- We do not use your content to train AI models without consent
- EU consumers have 14-day withdrawal rights for paid services
- Dutch law governs this Agreement
1. Introduction
1.1 Contracting Party
This User Agreement ("Agreement") is a binding contract between you and vaic.at B.V., a private limited company incorporated under the laws of the Netherlands, with its registered office at Noordeinde 99B, 2514 GD, The Hague, Netherlands ("vaicat," "we," "us," or "our").
1.2 Scope of Services
This Agreement applies to your use of:
- vaicat.com and vaic.at websites
- Affiliated mobile applications (mEUvy, EUorigin, priVIT, EUnify)
- APIs and developer services
- Any related services, features, or content
1.3 Age Requirements
You must be at least 16 years of age to use our Services. By using our Services, you represent and warrant that you meet this requirement.
1.4 Related Policies
The following documents are incorporated into this Agreement by reference:
- Privacy Policy (EU) - How we collect and use your data
- Community Guidelines - Acceptable conduct standards
- AI Use & Transparency Policy - How AI features work
2. Your Obligations
2.1 Account Registration
When you create an account, you agree to:
- Provide accurate and complete information
- Maintain only one account unless expressly authorized
- Keep your credentials secure and confidential
- Notify us immediately of any unauthorized access
2.2 Paid Services
For paid subscriptions and services:
- Subscriptions renew automatically unless cancelled
- You may cancel at any time through your account settings
- Access continues until the end of the current billing period
- Pricing changes require 30 days advance notice
2.3 EU Consumer Rights
If you are a consumer in the EU/EEA, you have a 14-day right of withdrawal for distance contracts. This period begins from the day the contract is concluded. For digital content, you may consent to immediate performance, which may affect your withdrawal rights once the service is fully provided.
3. Rights and Limits
3.1 Your Content
You retain ownership of all content you submit to our Services. By submitting content, you grant vaicat a:
- Non-exclusive, worldwide, royalty-free license
- Right to use, copy, modify, and display your content
- License solely for operational purposes (displaying, distributing, and improving Services)
3.2 AI and Your Content
Important: We do not use your personal data or content to train general-purpose AI models. Any AI training on user data requires explicit opt-in consent through in-product prompts or settings.
3.3 Ranking Transparency
Our search and ranking systems consider relevance, recency, completeness, and engagement. We do not accept payment to influence ranking or visibility unless clearly disclosed as "Promoted" or "Sponsored."
3.4 Data Access (Business Users)
Business users may access their own analytics and submitted data. You cannot access personal data of other users unless they have explicitly consented to share it with you.
4. Disclaimer and Limitation of Liability
4.1 Service Availability
Our Services are provided "as is" and "as available." We do not guarantee uninterrupted access or that the Services will be error-free.
4.2 Liability Cap
To the maximum extent permitted by law, vaicat's total liability is limited to the greater of:
- The fees you paid to us in the 12 months preceding the claim, or
- €1,000
4.3 Exceptions
These limitations do not apply to liability arising from:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Gross negligence or willful misconduct
- Violations of GDPR or applicable data protection law
5. Termination
5.1 Your Right to Terminate
You may close your account at any time through your account settings or by contacting support. Upon termination, you lose access to your account and content.
5.2 Our Right to Terminate
We may suspend or terminate your account if you violate this Agreement or our policies, or if required by law. Where possible, we will provide advance notice.
5.3 Surviving Provisions
The following sections survive termination: liability provisions, intellectual property rights, governing law, and any feedback you have provided.
6. Governing Law and Dispute Resolution
6.1 For Consumers (EU/EEA)
This Agreement is governed by Dutch law. You may bring claims in the courts of your country of residence or in the Netherlands. Mandatory consumer protection laws of your jurisdiction continue to apply.
6.2 For Business Users
This Agreement is governed by Dutch law. The courts of Amsterdam, Netherlands have exclusive jurisdiction over any disputes.
6.3 Mediation (P2B Regulation)
Business users may access voluntary mediation services through:
- Centre for Effective Dispute Resolution (CEDR)
- ADR Center for disputes arising under EU Regulation 2019/1150
7. Dos and Don'ts
7.1 Do
- Provide accurate information about yourself
- Use the Services for lawful purposes only
- Respect other users and their privacy
- Report content that violates our policies
7.2 Don't
- Misrepresent your identity or affiliation
- Scrape data or use automated tools without authorization
- Distribute malware or interfere with our systems
- Harass, threaten, or harm other users
- Violate any applicable laws or regulations
8. Complaints and Moderation (DSA Compliance)
8.1 Reporting Violations
You may report content that violates our policies through in-product reporting tools or by contacting support. We review reports without undue delay, prioritizing illegal content.
8.2 Statement of Reasons
When we take action on content or accounts, we provide a statement explaining our decision, the applicable rules, and your appeal rights.
8.3 Appeals
You may appeal moderation decisions within 14 days. Appeals are reviewed by qualified personnel not involved in the original decision. We aim to complete appeals within 14 business days.
9. EUnify App-Specific Terms
9.1 Application Purpose
EUnify is an informational comparison tool for EU educational institutions. It is not:
- An official government or institutional data source
- An admissions portal or application service
- A provider of financial or legal advice
9.2 Data Accuracy
Data is compiled from publicly available sources and may be incomplete or outdated. Always verify information directly with institutions before making application decisions. Data freshness indicators show verification status but do not guarantee accuracy.
9.3 Community Contributions
User-submitted information ("Community Notes") is reviewed by moderators but may contain errors. These contributions are subject to our Community Guidelines.
9.4 Recommendations
Algorithmic recommendations are suggestions based on your preferences (academic interests, budget, location). No payment influences ranking. EUnify uses rule-based matching, not machine learning.
9.5 Limited Liability
For EUnify specifically, our liability is limited to the greater of €100 or the fees paid in the preceding 12 months.
10. mEUvy App-Specific Terms
10.1 Application Purpose
mEUvy is an informational tool for comparing European cities and discovering job opportunities. It is not:
- An official government or employment data source
- A recruitment agency or employment service
- A provider of immigration, legal, or financial advice
10.2 Data Accuracy Disclaimer
City data is compiled from publicly available sources and may be incomplete, outdated, or inaccurate. Always verify information with official sources before making relocation decisions. Job listings are provided by third-party employers and we do not guarantee their accuracy or legitimacy.
10.3 Talent Bank
The Talent Bank is an optional feature allowing you to make your profile visible to verified recruiters. By joining:
- You consent to recruiters viewing your public profile information
- You can control exactly what information is visible
- You can leave the Talent Bank at any time
- Your salary information is never shared (stored device-only)
10.4 Job Listings & Advertising
Some job listings are marked as "Sponsored" or "Promoted." Per Digital Services Act Article 26:
- Sponsored listings are paid advertisements
- We clearly disclose when content is advertising
- Sponsored status does not affect our matching algorithm
- Employers are responsible for listing accuracy
10.5 CathAI Assistant
mEUvy includes CathAI, an AI assistant that provides personalized recommendations. CathAI:
- Processes all data on your device using Apple Foundation Models
- Does not send your personal data to external AI services
- Is classified as "limited risk" under the EU AI Act (Article 52)
- Can be disabled at any time in Settings
10.6 Free Services
mEUvy's core features (city comparison, job search, CathAI) are free. Applying for jobs is always free – never pay an employer to apply for a position. Report any such requests immediately.
10.7 Limited Liability
For mEUvy specifically:
- We are not liable for decisions based on city data or job listings
- We are not liable for actions of recruiters or employers
- Our total liability is limited to €100 or fees paid in the preceding 12 months
